Organizational Setting

The main aim of FAO Country Office, headed by the FAO Representative, is to assist governments to develop policies, programmes and projects to achieve food security and to reduce hunger and malnutrition; to help develop the agricultural, fisheries and forestry sectors; and to use their environmental and natural resources in a sustainable manner. FAO Kyrgyzstan assists the Government of the Kyrgyz Republic to develop policies, programmes and projects to address the root causes of hunger and malnutrition, to develop the agricultural, fisheries and forestry sectors and to use environmental and natural resources in a sustainable manner. FAO participates in the development and implementation of field projects in the sectors of food security, agriculture and rural development. This requires the integration within the broader framework of sustainable food and agriculture that aims at increasing production and productivity, addressing climate change, and managing natural resources; and enhance rural livelihoods.
In this context, FAO is implementing in collaboration with the Government of the Kyrgyz Republic the FAO/GEF regional project “Lifecycle Management of Pesticides and Disposal of POPs Pesticides in Central Asian countries and Türkiye”. The project aims at the environmentally sound disposal of up to 900 metric tonnes of POPs and obsolete pesticides and remediate pesticide-contaminated sites (Component 1); strengthen the institutional and regulatory framework for managing pesticides throughout their lifecycle (Component 2); increase the successful uptake of alternatives to chemical pesticides on key crops (Component 3); and share project lessons (Component 4). The project beneficiary countries are Azerbaijan, Kazakhstan, Kyrgyzstan, Tajikistan, and Türkiye.


Reporting Lines

The National Legal Specialist under the technical supervision of the FAO HQ Development Law Service (LEGN) and FAO-REU Agricultural Officer (LTO) with the operational supervision of the FAO Representative in Kyrgyzstan and in collaboration with the international legal consultant will have the followings tasks\:


Technical Focus

Support updates and development of pesticides management related legislation of Kyrgyzstan.


Tasks and responsibilities

• Develop a draft regulation on the licensing of key pesticide activities (including the sale, special uses, and import of pesticides). Discuss the draft with the FAO legal team, the technical team, and the national counterparts.
• Develop new regulation on control and supervision of the sales of pesticides and agrochemicals. Develop relevant recommendations. Discuss the draft with the FAO legal team, the technical team and the national counterparts.
• Develop the necessary revisions to the existing legislation or develop new regulations for implementation and mandating the use of a new online pesticide management system in the Ministry of Agriculture.
• Support the development of a strategy for extended producers’ responsibility and containers (packaging) management. Identify the changes needed in legislation and support the drafting of the necessary regulations or legal amendments.
• Prepare an end of assignment report.
• Perform any other duties when required related to pesticides legislation.

CANDIDATES WILL BE ASSESSED AGAINST THE FOLLOWING


Minimum Requirements

• University degree in Law
• 5 years of experience in agriculture legislation and regulation
• Working knowledge of English and working knowledge of Russian and Kyrgyz is required
• National or Resident of the Kyrgyz Republic

• Sound knowledge of Kyrgyz legislation on agriculture and pesticide management.
