Job Description

Project Context and Scope
 
IOM Germany is seeking consultancy services to assess the feasibility of establishing a non-profit entity under German law. The consultant will be expected to explore relevant legal structures (including Stiftungs- and Vereinsreicht – Law on Foundations and Associations), and provide strategic guidance on legal frameworks, donor landscape, operational setup, and launch considerations within the German context. The assignment will include tailored recommendations based on project parameters

Responsibilities

Tasks to be performed under this contract
  • Map legal/administrative options for German non-profit vehicles (Verein/Stiftung/gGmbH), including tax-exempt status, governance, compliance, GDPR and considering policies and frameworks of international organizations.
  • Analyse donor markets (corporates, foundations, High-Net-Worth Individuals ( HNWIs), diaspora, and German governmental funding lines) and recommend positioning, early opportunities, and risk controls.
  • Propose a lean operating model (governance, staffing, finance controls, data & donor care, brand/comms, due diligence) with 12–18-month roadmap if actioned and budget draft.
  • Risk and Chance assessment considering project details.
 
Performance indicators for the evaluation of results
  • Deliverables submitted on time, complete, and actionable in English language.
  • Legal and operational recommendations fit-for-purpose.
  • Costings and timelines realistic; risks and mitigations clearly articulated.
  • Positive feedback from IOM Germany, and other involved partner.

Qualifications

Education
  • Advanced degree in Law, Public Administration, Non-profit Management, or Finance.
Experience
  • 7–10+ years in German non-profit set-up/operations, fundraising strategy, or foundation/Verein governance; experience with governmental funding lines an asset.
Skills
  • Demonstrated experience producing costed business cases and governance frameworks.
Languages
  • Fluency in German and English; strong writing and presentation skills.
IOM’s official languages are English, French and Spanish.
Proficiency of language(s) required will be specifically evaluated during the selection process, which may include written and/or oral assessments.
 
Travel required
  • Travel to Berlin Office will be required occasionally.
